Trucking company Mainfreight Distribution Pty Ltd has been fined $4,000 for allegedly failing to carry the required safety equipment while transporting dangerous goods in Mayfield West last year.
The NSW Environment Protection Authority issued Mainfreight with the Penalty Notice following an inspection of a vehicle load, on 10 December 2018, which included 16 drums of xylene, a flammable liquid used in industrial applications.
EPA Director Hunter Karen Marler said it was alleged the truck was not equipped with the required safety equipment including fire extinguisher, chemically resistant gloves, eye wash kit and correct torch.
“It’s essential trucks carrying dangerous goods are equipped with the correct safety equipment. This is critically important for the protection of the driver and first responders in the event that something goes wrong,” Ms Marler said.
“We’ve seen plenty of evidence in recent times of the dangers involved from incidents involving heavy vehicles carrying flammable goods when things do go wrong.”
In recent years, Mainfreight have been prosecuted twice for dangerous goods transportation offences.
Mainfreight have committed to implementing revised procedures and systems to ensure future compliance.
Penalty notices are one of a number of tools the EPA can use to achieve environmental compliance including formal warnings, official cautions, licence conditions, notices and directions and prosecutions. In this instance the EPA issued a penalty notice. The notice recipient may pay the penalty notice, seek a review, or elect to have the matter determined by a court.
